Excellent analysis. It addresses what many people fail to focus on - that to be legitimate, an EO must be in furtherance of an actual pre-existing Presidential power. For instance, the Emancipation Proclmation was specifically grounded by Lincoln in military necessity, deriving from his Contitutional role of Commander in Chief. EO's shouldn't be allowed to arise out of a vaccuum, though someone has to have the guts to point that out and act to defy extra-constitutional EO's.
